SALT LAKE CITY, UTAH – This week local apparel company, Offside Apparel, had their collegiate license from the University of Utah revoked. For the past 10 years Offside Apparel, owners of runningredshirts.com, has designed, printed, and sold licensed University of Utah apparel. During the week leading up to the Las Vegas Bowl Running Red Shirts shared an image of a t-shirt that says “The Only Cougar I Like Is Your Mom” designed and sold Salt Lake Clothing Company on the Running Red Shirt’s Facebook page.
Offside Apparel received an agreement violation notice from the Collegiate Licensing Company’s (CLC), University of Utah’s trademark management service company, legal team alleging Offside Apparel of selling unapproved designs. A response was sent explaining that the design in question was not designed, printed or sold by Offside Apparel. To avoid any further conflict or confusion the posts were promptly removed from all Running Red Shirts social media pages. Despite repeated attempts to prove Offside Apparel was not responsible for the design, this week they were notified by the CLC that the University of Utah would not renew their collegiate license due to “unapproved artwork designs in the marketplace” ending their 10-year business relationship.
Offside Apparel’s owner Nate Bowen said, “It’s disappointing. Offside Apparel didn’t design, sell, or profit in any way from ‘The Only Cougar I Like is Your Mom’ shirt. We shared the design on social media because it is relevant to our target market. There are some misunderstandings but ultimately we were too close to it.”
Running Red Shirts has 60 days to liquidate all remaining licensed University of Utah inventory or it will have to be destroyed per the CLC licensing agreement. All remaining Utah apparel will be sold at 50% until the end of February.
